Meeting Act requires all meetings of public bodies to be preceded by advance
public notice specifying the time and place of each such meeting.
A public body is defined as governing bodies of municipalities, boards of county
commissioners, boards of public and higher education, and all boards, bureaus,
commissions, agencies, trusteeships, authorities, councils, committees, public
trusts, task forces or study groups supported in whole or in part by public
funds or entrusted with the expending of public funds, or administering public
property, and shall include all committees or subcommittees of any public body
[25 O.S., § 304]. The record
keeper of these notices depends on the type of public body. The Secretary of
State is the record keeper for all state
public
bodies. Pursuant to the Open
Meeting Act, state public bodies are required to send meeting notices to the
Secretary of State for the following: Regularly
Scheduled Meetings - Written notice must be provided by December 15 of each
calendar year of the date, time and place of the regularly scheduled meetings
for the following calendar year. If
any change is to be made to the date, time or place of regularly scheduled
meetings, notice must be given not less then ten (10) days prior to the
implementation of such change. Special
Meetings – Notice of special meetings must be given in writing, in person,
or by telephonic means at least forty-eight (48) hours prior to said meetings. The
Act does NOT require notification to the Secretary of State of emergency,
continued, or reconvened meetings. Meeting
agendas are not filed with the Secretary of State’s Office.
Public bodies must display public notice of regularly scheduled and
special meetings at least twenty-four (24) hours prior to the meeting, excluding
Saturdays, Sundays, and legally declared holidays by the State of Oklahoma. The
notice must be posted in prominent public view at the principal office of the
public body or at the location of the meeting if no office exists.
The notice must include the date, time, place, and agenda.
