Name Reservation
Once an individual has decided to start a business their first step
should be to check with the Oklahoma Secretary of State to check the
availability of the proposed name of the business.
A name can be researched for availability prior to registration by contacting
the Secretary of State's Office at 521-3912, or by visiting the customer service
terminals in the Secretary of State's Office during business hours.Once the availability of the proposed business name has been verified a
request to reserve the name may be submitted by mail, for a period of 60
days, with a $10.00 filing fee.
The 60 day reservation period allows the business customer to determine if
they wish to create a formal business structure that requires filing with
the Oklahoma Secretary of State. If a decision has been made to create a formal business structure,
the reservation period also allows for the time to draw up their business
documents and submit them for filing along with the appropriate filing fee.
Although not required by statute, a trade name report may be filed
with the Oklahoma Secretary of State, if an informal business structure
(such as a sole proprietor) has been chosen. The trade name report allows
the business name to be protected on the records of the Oklahoma Secretary
of State in the same manner as that of a formal business structure.
